How I became a Debt Collector in the Building & Construction Industry.

I have worked in the building & construction industry all of my life, since I was 15 in fact. I love it. I love building things. I love the feeling I have when I stand back and look at what I built from nothing. The beauty of the aesthetics, the usefulness of the facility, the character that the built environment in-vibes.

I understand the effort that goes into the bringing design to life, built to work, built to be enjoyed and built to last.

That I was able to do work that I loved to provide for my family was simply just a bonus.

But when people used me to get a job done and didn’t pay me I was left feeling cheated and foolish.

Cheated because I did the right thing and acted in good faith assuming that getting paid for my work was a given.

Foolish because it just didn’t occur to me that that someone wouldn’t honour their end of the bargain.

After all, mum and dad had taught me that my word was my bond – I assumed that everyone paid their bills.

After writing off a small fortune as bad debts because some people have no ethics and no honour, and after spending a small fortune on lawyers trying to bring these people to justice with little success, all of a sudden there was another alternative – The Building & Construction Security Of Payments Act 1999.

It was 2000 and we had all been flat out for the last few years getting all of the 2000 Olympics facilities built and lots of us were owed money for all that work and people just weren’t paying.

Then out of the blue word slowly started to spread about the Security Of Payments Act. New law that helped small business like mine get paid quickly at low cost. It seemed to work every time.

Since 2000 all of my invoices stated that they were Payment Claims made under the Building & Construction Industry security of Payments Act 1999. And the people that owed me money didn’t even blink at it – it meant nothing to them. At least that was until it was too late and I had a Court Judgement against them.

In no time flat I was the Guru and was running claims under the Security Of Payments Act for all my mates in the industry, some of my suppliers, fellow subbies and even my clients. And as the good news spread like wildfire that the way to get paid for building and construction work was by Glenn Bower running a Security Of Payments act claim for you all of a sudden I had no time for building and found myself working as a full time Debt Collector.

Traditional debt collectors haven’t got a clue how to recover money for tradies. They are stuck in the traditional methodologies of statement of claims in courts that only serve to provide lawyers with endless opportunities to gouge fees and fail to get their clients paid.

Working as a Debt Collector in the building and construction industry helping people like me get paid for their work now gives me the same level of satisfaction I used to get from standing back and looking at what I had created from a variety of raw materials. Security Of Payments Act NSW Flowchart

There is a lot of value in understanding what your rights are under a contract and under the Security Of Payment Act. What, how and when!?!

Debt Recovery

Any unpaid amount from a previous claim can be included in  current claim ncluding all variations

Construction Contracts

Construction Contracts have many provisions for resolving payment disputes but no contractual provision can be used to contract out of the Security Of Payment Act

Retentions

You must claim retentions on the first reference date after the end of the defects liability period

Variations

You are entitled to be paid for all work carried out over and above the contract work.
